All content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of Fishbowl Ventures Sdn Bhd (“The Fish Bowl/the Company”) or its content suppliers and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Unauthorized use of any materials on this Site may violate these laws and is strictly prohibited.
User Accounts
If you create an account on this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. We reserve the right to terminate accounts, refuse service, remove or edit content, or cancel orders at our sole discretion.
Third-Party Links
This Site may contain links to third-party websites or services that are not owned or controlled by The Fish Bowl. The Fish Bowl has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that The Fish Bowl shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
The Fish Bowl Fishies Club
Effective Date
This Fishies Club Card Agreement (“Agreement”) is between you and The Fish Bowl (“we” or “us”) and describes the terms and conditions that apply to your Fishies Club Card. By buying or using your Fishies Club Card, you agree to these terms.
About Your Account
We issue the Fishies Club Card to you to make your relationship with us more rewarding. Every The Fish Bowl restaurant accepts your Fishies Club Card. Fishies Club Cards are not intended for use by anyone under the age of 13. If you are between the ages of 13 and 18, you may only use Fishies Club Cards under the supervision of a parent or legal guardian who agrees to be bound by this Agreement.
Fishies Member’s Cubes
Fishies Club Members are entitled to earn 80 cubes (points) for every RM1 nett spent at any The Fish Bowl outlet.
Use of Fishies Club Cards by Businesses
There are specific requirements and restrictions on the use of Fishies Club Cards by businesses, such as prohibitions against reselling Fishies Club Cards and using them to solicit new customers. Please contact us at [email protected] for inquiries about collaborating on Fishies Club Card usage.
Promotional Programs
From time to time, we may, at our sole discretion, run promotional programs associated with the Fishies Club Card program (“Promotions”). Such Promotions are subject to these terms as well as any additional terms indicated in connection with the Promotions. We reserve the right to modify the terms and conditions of any Promotion at any time, including terminating the Promotion.
Fees for Fishies Club Card
A charge of RM10 will apply upon registration of your Fishies Club Card. No activation, service, dormancy, or inactivity fees will be charged in connection with your Fishies Club Card after registration.
Receipts and Transaction History
You can check the points balance of your Fishies Club Card at the cashier of any The Fish Bowl restaurant. After registration, you can also check your points online. You will need to present your Fishies Club Card to access your account. We do not provide statements of activity for your Fishies Club Card.
Billing Errors and Corrections
We will correct the point balance of your Fishies Club Card if we determine that a clerical, billing, or accounting error has occurred. If you have questions regarding your transaction history, any corrections, or if you wish to dispute a transaction or correction on your Fishies Club Card, please contact Customer Service at +603 5613 6862. Providing sufficient details will allow us to review your claim and inform you of our findings. We will promptly correct any errors after completing our review. If no error is found, we will explain our findings. We are not obligated to review or correct billing errors unless you notify us with sufficient details within sixty (60) days of the transaction in question.
Points Expiry
All reward points earned through purchases or promotional activities are valid for a period of one (1) year from the date of purchase. After this period, any unused points will automatically expire and be removed from your account. It is your responsibility to monitor the points balance and the expiration dates. Expired points cannot be reinstated or redeemed under any circumstances.
Fraud Associated with Your Fishies Club Card or Card Balance
We may refuse to accept or limit the use of any Fishies Club Card or its point balance if we reasonably believe the use is unauthorized, fraudulent, or otherwise unlawful, and we consider such action necessary to manage our risk. The Fish Bowl does not control the sale of Fishies Club Cards or the pricing and point balance denominations offered by independent sellers. Therefore, The Fish Bowl is not liable for any third-party fraud or unlawful activity associated with any Fishies Club Card point balance. If we discover that any Fishies Club Card or point balance was obtained through fraud or other unlawful means, we may, at our sole discretion, cancel the affected Fishies Club Cards and retain the related point balances without notice.
Registration and Liability for Unauthorized Transactions
To register your Fishies Club Card, please visit any The Fish Bowl restaurant. By registering, you agree to: (i) provide complete and accurate information about yourself; and (ii) update this information if it changes. Failure to provide or update this information, or if we have reasonable grounds to suspect that you have not done so, may result in the disabling of your Fishies Club Card at our sole discretion. If you believe your Fishies Club Card has been disabled in error, please call +603 5613 6862. You are responsible for: (a) the accuracy of all information you provide; and (b) maintaining the confidentiality and security of your Fishies Club Card information.
If your Fishies Club Card or its information is lost or stolen, anyone who obtains possession may use your Card. You are responsible for all redemptions on your Fishies Club Card, including unauthorized ones. However, if your Fishies Club Card is lost, stolen, or damaged, it can be replaced with the remaining point balance at the time you contact us.
If your registered Fishies Club Card is lost, stolen, or damaged, contact us immediately by emailing [email protected] or calling +603 5613 6862. Your point balance will be protected from the time you notify us. We will freeze the remaining point balance and transfer it to a replacement Fishies Club Card.
Changes to This Agreement
We may amend this Agreement at any time. The amended Agreement will be posted on our website at http://thefishbowl.my/fishies-club. For thirty (30) days following the posting, we will also post a notice on our website indicating that the terms of this Agreement have changed. Any changes, additions, or deletions will become effective when we post the revised Agreement. Unless stated otherwise, these changes will apply to your future and existing Fishies Club Cards. You are deemed to accept the changes if: (1) you do not notify us in writing within 20 days of our notice, or any other time specified in the notice; or (2) you use your Fishies Club Cards after the notice period. If you notify us that you do not accept the changes, we will cancel your Fishies Club Cards and stop you from earning points and enjoying benefits. However, you may still redeem the point balance on your cancelled Fishies Club Card.
Cancellation of This Agreement
We may suspend or terminate this Agreement and revoke or limit any or all rights and privileges granted to you at any time without notice or liability. Termination may result from fraudulent or unauthorized use of the Fishies Club Card, including failure to provide valid information. For example, if we suspect unauthorized redemptions, we will cancel the affected Fishies Club Cards and retain any point balances associated with those Cards. If we terminate this Agreement without cause, you can only redeem the point balance on your cancelled Fishies Club Card. You will not be able to earn points or enjoy other Fishies Club Card benefits.
Disclaimers and Limits of Liability
The Fish Bowl makes no representations, warranties, or conditions of any kind, express or implied, with respect to the Fishies Club Card, including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. The Fish Bowl does not guarantee that your Fishies Club Cards will always be accessible or accepted.
In the event The Fish Bowl is found liable to you, your recovery shall be limited to actual and direct damages, and such damages shall not exceed the last point balance held on your Fishies Club Card. The Fish Bowl is not liable for any incidental, indirect, or consequential damages (including, without limitation, loss of profit, revenue, or use), or any punitive or exemplary damages arising out of or in connection with this Agreement, whether in contract, warranty, tort (including negligence), product liability, strict liability, or other theory, even if advised of the possibility of such damages. The Fish Bowl is not liable for unauthorized access to, alteration, theft, or destruction of a Fishies Club Card through accident, misuse, or fraudulent means by you or any third party, or due to delays or mistakes beyond our control.
Assignment
We may assign all or part of this Agreement without notice to you. Upon such assignment, we are released from all liability. You may not assign this Agreement without our prior written consent, and any attempted assignment will be void.
Entire Agreement and Construction
This Agreement constitutes the complete and exclusive statement of the agreement between you and The Fish Bowl and supersedes all prior proposals and agreements regarding your Fishies Club Card. If any provision of this Agreement is determined to be illegal or unenforceable, that provision will be removed to the minimum extent necessary so that the remainder of this Agreement remains in full force and effect.
